These terms govern your use of this website, the free home-value tool, and the SellSmart app (together, "SellSmart"). By using the site or purchasing the product, you agree to them.

The most important term, in plain English: SellSmart is an educational product. It provides general information and tools about the home-selling process. It is not a real estate brokerage, agent, attorney, appraiser, lender, or financial advisor, and nothing in it is legal, tax, investment, or real-estate advice for your specific situation or transaction. We do not represent you in any deal, negotiate for you, or prepare documents for your transaction. For advice about your specific sale, consult licensed professionals in your state.

1. The free home value estimate

The valuation shown by this site is a preliminary, automated estimate generated from market data and the details you enter. It is not an appraisal, broker price opinion, or comparative market analysis, and must not be relied on for lending, legal, tax, or transactional purposes. Actual sale prices vary.

2. Your license to the product

When you purchase SellSmart, you get a personal, non-exclusive, non-transferable license to use the app on devices you own, for your own home sales (including using it to stay informed while working with an agent). You may not resell, redistribute, share, publish, or upload the product files, or use them to build a competing product. The product and its content are our intellectual property.

3. Refunds

30-day money-back guarantee: if you're not satisfied for any reason, contact us (or reply to your receipt email) within 30 days of purchase for a full refund. Refunds are processed through our payment processor.

4. No guarantee of results

Savings figures on this site are estimates based on average listing commissions (~2.7%); commissions are negotiable and vary. Whether your home sells, at what price, and on what timeline depends on your market, your home, and your decisions. We do not guarantee any outcome.

5. Accuracy and state law

Real estate requirements vary by state and county and change over time. We work to keep the content current, but you are responsible for verifying requirements that apply to your transaction. Where the product links to third-party services (flat-fee MLS providers, registries, directories), those links are conveniences, not endorsements — vet and contract with any provider directly.

6. Limitation of liability

To the maximum extent permitted by law, SellSmart and its owners are not liable for indirect, incidental, consequential, or special damages arising from use of the site or product, and our total liability for any claim is limited to the amount you paid for the product. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

7. Acceptable use

Don't misuse the site: no scraping, no submitting false information to the lead forms, no attempting to access other users' data or our systems.

8. Communications

If you opt in on the quiz, you agree to receive your report and occasional home-selling tips by text and email. Message and data rates may apply. Reply STOP to any text or unsubscribe from any email to opt out — see our Privacy Policy.

9. Disclaimer of warranties

THE SITE, THE FREE VALUATION TOOL, AND THE PRODUCT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the content is error-free or current for your jurisdiction, or that the site will be uninterrupted or secure.

10. Your responsibility & no reliance

You are solely responsible for your real estate transaction and every decision in it — pricing, disclosures, contracts, negotiations, and closing. You agree you will independently verify any information material to your transaction and engage licensed professionals where appropriate, and that you are not relying on SellSmart as a substitute for them. You assume all risks associated with selling (or buying) real property.

11. Indemnification

You agree to defend, indemnify, and hold harmless SellSmart and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the site or product, your transaction, your violation of these terms, or your violation of any law or third-party right.

12. Binding arbitration & class action waiver

Please read this section carefully — it affects your legal rights. Any dispute arising out of or relating to these terms, the site, or the product will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as AAA) under its consumer rules, held in Los Angeles County, California or remotely. You and SellSmart each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. Either party may instead bring an individual claim in small claims court, and nothing in this section prevents claims for public injunctive relief where such waivers are unenforceable under California law. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase or use, stating your name and that you opt out of arbitration.

13. Governing law

These terms are governed by the laws of California, without regard to conflict-of-law rules. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state or federal courts located in Los Angeles County, California.

14. General

If any provision of these terms is found unenforceable, the rest remain in effect (severability). These terms are the entire agreement between you and SellSmart regarding the product and replace any prior understandings. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a sale of the business. We are not liable for delays or failures caused by events beyond our reasonable control.

15. Changes

We may update these terms; the date above reflects the latest version. Continued use after changes means you accept them.
