Any dispute arising out of or relating to these terms, the site, or the product will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as AAA) under its consumer rules, held in Los Angeles County, California or remotely. You and SellSmart each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. Either party may instead bring an individual claim in small claims court, and nothing in this section prevents claims for public injunctive relief where such waivers are unenforceable under California law. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase or use, stating your name and that you opt out of arbitration.
These terms are governed by the laws of California, without regard to conflict-of-law rules. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state or federal courts located in Los Angeles County, California.
If any provision of these terms is found unenforceable, the rest remain in effect (severability). These terms are the entire agreement between you and SellSmart regarding the product and replace any prior understandings. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a sale of the business. We are not liable for delays or failures caused by events beyond our reasonable control.
We may update these terms; the date above reflects the latest version. Continued use after changes means you accept them.
